The national implementation of immigration provisions is effected through the Draft Federal Act on Foreign Nationals and Integration (D-FNIA). Central elements are the safeguard clause with autonomous activation by the Federal Council, a comprehensive monitoring concept, cantonal competences and regulations on permanent residence rights.
The draft law transposes the FMPA provisions into national law:
| Area | Implementation |
|---|---|
| Safeguard clause | Art. 21b D-FNIA |
| Monitoring | Annual indicator review |
| Permanent residence | Art. 41d D-FNIA |
| Termination of residence | Expanded competences |
| EFTA nationals | Same rules as FMPA |
The safeguard clause is the central steering instrument of immigration policy:
| No. | Indicator | Metric |
|---|---|---|
| 1 | Net immigration | EU/EFTA net immigration relative to population |
| 2 | Unemployment rate | Comparison with EU average and previous periods |
| 3 | Social benefit uptake | Uptake by EU/EFTA nationals |
| 4 | Wage pressure | Wage development in affected sectors |
In addition to the key indicators, further factors may be considered:
Monitoring is a central element of safeguard clause implementation:
| Stakeholder | Role |
|---|---|
| Cantons | Provide regional data, are consulted |
| Social partners | Sector-specific information, position statements |
| Parliament | Receives annual report, can provide political impulses |
| Federal Council | Decides on activation |
When the safeguard clause is activated, various measures are available:
| Duration | Competence |
|---|---|
| Up to 12 months | Federal Council can order autonomously |
| Over 12 months | Approval by Federal Assembly required |
The permanent residence right is subject to strict conditions:
| Requirement | Detail |
|---|---|
| Duration of residence | 5 years of uninterrupted lawful residence |
| Gainful employment | Only for economically active persons and their family members |
| Self-sufficiency | No social welfare dependency |
| Extension upon welfare | Waiting period extended in case of social welfare dependency |
In the EU, there is an automatic permanent residence right after 5 years -- regardless of employment. Switzerland negotiated a more restrictive solution:
The regulations apply equally to nationals of EFTA member states:
The cantons retain important enforcement competences:
